Terms of Service

Please read these terms carefully before using KovaShield. By creating an account or deploying KovaShield on your systems, you agree to be bound by these terms.

1. The Service

KovaShield is a cybersecurity service provided by TNZ Productions LLC ("TNZ," "we," "us") that deploys honeypot endpoints, active defense systems, and threat intelligence tools on your infrastructure to detect, log, and respond to unauthorized access attempts. The service includes threat logging, IP reputation scoring, AbuseIPDB reporting, cryptographic evidence packaging, and optional law enforcement reporting tools.

You Must Own or Have Permission to Monitor Your Systems

KovaShield may only be deployed on systems, networks, and domains that you own or have explicit written authorization to monitor. Deploying KovaShield on systems you do not own or control is a violation of these terms and may constitute a federal crime under the Computer Fraud and Abuse Act (18 U.S.C. § 1030).

You are responsible for ensuring your use of KovaShield complies with all applicable laws in your jurisdiction, including but not limited to:

In all-party consent states (including Washington, California, and Florida), you must ensure appropriate notice is provided before intercepting communications. TNZ provides template disclosure language in our documentation but is not responsible for your legal compliance.

Accurate Information

You must provide accurate account information and keep it current. False information, including false authorization claims, is grounds for immediate termination.

Security of Your Account

You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately at security@kovashield.com if you believe your account has been compromised.

5. Evidence Packages and Law Enforcement Reporting

KovaShield generates cryptographically sealed evidence packages for each threat event. These packages are designed to support law enforcement reporting and legal proceedings. By using the law enforcement reporting feature, you acknowledge that:

6. Network Segmentation Requirement

You are responsible for ensuring that KovaShield honeypot endpoints are properly isolated from your production systems and the open internet. TNZ is not liable for damages arising from insufficient network segmentation that allows a threat actor to use your honeypot as a springboard to attack third parties or access your production data.

7. Intellectual Property

KovaShield, its source code, documentation, and all associated intellectual property are owned by TNZ Productions LLC. You are granted a limited, non-exclusive, non-transferable license to use KovaShield for your internal security purposes during your subscription term. You may not copy, modify, reverse engineer, or create derivative works from KovaShield.

Threat intelligence data generated by your deployment belongs to you. TNZ does not claim ownership of threat data captured on your systems.

8. Service Availability

We target 99.9% uptime for KovaShield's API and dashboard. Planned maintenance will be announced at least 24 hours in advance. We are not liable for outages caused by third-party infrastructure, force majeure events, or DDoS attacks against our own infrastructure.

9. Disclaimers

KovaShield is provided "as is" without warranty of any kind. We do not warrant that the service will prevent all cyberattacks, detect all threats, or provide legally admissible evidence in all jurisdictions. Cybersecurity is an inherently imperfect field and no tool provides absolute protection.

TNZ does not provide legal advice. Nothing in our documentation, terms, or communications constitutes legal advice. Consult a licensed attorney regarding your legal obligations before deploying KovaShield.

10. Limitation of Liability

To the maximum extent permitted by law, TNZ Productions LLC's total liability to you for any claim arising from your use of KovaShield shall not exceed the amount you paid to TNZ in the 12 months preceding the claim. TNZ is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

11. Indemnification

You agree to indemnify, defend, and hold harmless TNZ Productions LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of KovaShield; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your deployment of KovaShield on systems you are not authorized to monitor.

12. Termination

Either party may terminate your account at any time. TNZ may terminate immediately and without notice for violations of these Terms, particularly unauthorized system monitoring or illegal use. Upon termination, your access to KovaShield will be revoked and your account data will be deleted within 30 days, except for data subject to legal holds or law enforcement requests.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Spokane County, Washington.

14. Changes to Terms

We will notify you of material changes to these Terms by email at least 14 days before they take effect. Continued use of KovaShield after the effective date constitutes acceptance of the new Terms.
